Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MailQSL service (the “Service”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

MailQSL lets you design QSL postcards, upload an amateur radio contact log (ADIF/CSV/Excel), look up mailing addresses for callsigns, preview cards, and pay to have those cards physically printed and mailed via our print-and-mail provider.

2. Eligibility and account

You must be at least 18 years old and able to enter into a binding contract to use the Service. You agree to provide accurate information, keep your password secure, and accept responsibility for activity under your account.

3. Pricing, payment, and approval

The current price per mailed card is shown on the homepage and in the checkout flow. Prices may change with notice; the price shown at the time you approve a job is the price you pay for that job.

Before any cards are printed or mailed, you review and approve a preview of each card and the total cost of the job. Payment is collected at approval via Stripe. By approving a job you authorize us to charge the payment method on file and to submit the corresponding cards to our print-and-mail provider for fulfillment.

4. No refunds for mailed cards

Once a card has been submitted to the print-and-mail provider, it cannot be cancelled and is non-refundable. This includes cards that are returned as undeliverable, cards with typos or incorrect content that was approved by you, and cards with incorrect recipient information that was approved by you. Please verify the preview of every card and the recipient list carefully before approving a job — the preview is what we send to print.

If a card is not delivered because of a verified failure on our side or on our print-and-mail provider’s side (for example, we printed something materially different from the approved preview), contact mailqsl-support@googlegroups.com and we will work with you to make it right at our discretion.

5. Your content; address lookup; accuracy

You retain ownership of the artwork, templates, log data, and contact information you upload (“Your Content”). You grant MailQSL a limited license to host, display, transmit, and process Your Content as needed to provide the Service — including transmitting card content and recipient addresses to our print-and-mail provider so they can print and mail the cards.

You represent that you have the right to use Your Content and to send the postcards you submit. Address lookups via HamQTH, Callook.info, or other public services are provided as a convenience; we do not guarantee that any looked-up address is current, correct, or that the person at that address consents to receiving mail. You are responsible for the accuracy of recipient addresses and the appropriateness of sending mail to them.

MailQSL does not proofread, edit, or correct your card content. What you approve in the preview is what is printed and mailed.

6. Delivery and tracking

Cards are mailed via the U.S. Postal Service (or its international partners). Typical delivery times are 3–5 business days within the United States and longer for international mail, but actual delivery times are not guaranteed and depend on the carrier. Tracking information shown in your dashboard reflects the latest status reported by our provider; we are not responsible for carrier delays, mishandling, or loss.

7. Acceptable use

You agree not to use the Service to:

  • Mail unlawful, threatening, harassing, defamatory, fraudulent, obscene, hateful, or sexually explicit content.
  • Send commercial solicitations, bulk advertising, political campaign mail, or other content unrelated to confirming a ham radio contact (QSL).
  • Impersonate another person or callsign, or send mail in a way designed to deceive the recipient about who is sending it.
  • Mail to anyone who has asked you not to contact them, or in violation of any applicable law (including laws about unsolicited mail and harassment).
  • Upload malware, attempt to gain unauthorized access to the Service, scrape the Service, or interfere with its operation.
  • Use the Service to violate the terms of any third-party service (including Stripe, Lob, HamQTH, Callook, or Google).

We may refuse to print, cancel a job, suspend, or terminate accounts that we reasonably believe are violating these Terms.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms or if we are required to do so by law. Pending jobs that have already been submitted to our print-and-mail provider will continue to fulfillment.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT THE ACCURACY OF ANY ADDRESS LOOKUP, THE DELIVERY OF ANY PARTICULAR PIECE OF MAIL, OR THE CONTENT OF ANY THIRD-PARTY SERVICE THE SERVICE INTEGRATES WITH.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MAILQSL, ITS OPERATORS, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MAILQSL IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, IN WHICH CASE THEY APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify and hold MailQSL harmless from any claim or demand (including reasonable attorneys’ fees) arising out of your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right — including, for example, mail you send through the Service.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you by email or in the app. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States and the State of New Jersey, without regard to its conflict of laws principles. Disputes will be resolved in the state or federal courts located in New Jersey, and you consent to personal jurisdiction there.
